During lockdown period keeping in view the (COVID-19) pandemic, this case has been listed today in my chamber under the order of Hon'ble the Chief Justice.
Heard Sri Seemant Singh, learned counsel for the petitioner and Sri M. C. Chaturvedi, learned Additional Advocate General/learned Senior Counsel assisted by Sri Suresh Singh, Sri Arvind Kumar, learned Additional Chief Standing Counsel and Sri Chandan Kumar and Sri Rajesh Kumar Mishra, learned Standing Counsel for the State and Sri P. D. Tripathi, learned counsel for the respondent-Basic Education Board through Video Conferencing.
The petitioner has preferred the present writ petition inter-alia with the following prayers :-
"(a) Issue a writ, order or direction in the nature of Mandamus directing the respondents to allow the petitioner to rectify his inadvertent human error in respect of filling incorrect entry relating to total marks of Graduation as 11800 to correct total marks of his Graduation as 1800 in the online application form of Assistant Teacher Recruitment Examination 2019.
(b) Issue a writ, order or direction in the nature of Mandamus directing the respondents to consider the selection of the petitioner on the post of Assistant Teacher to be appointed in Primary Schools, taking into account his actual total marks of Graduation i, e., 1800 marks in pursuance of Government Order dated 13.05.2020 issued by Special Secretary, Government of U.P., Lucknow."
After some arguements, the petitioner has confined his prayer only to the effect that the representations submitted by him before the authorities dated 16.5.2020 as well as 20.5.2020, copy of which is appended as annexure 7 to the writ petition, be decided expeditiously.
Without entering into the merits of the case, petitioner is directed to submit a fresh representation along-with copy of the earlier representations dated 16.5.2020 as well as 20.5.2020 as well as self attested computer generated copy of this order downloaded from the official website of High Court Allahabad before the Secretary, U.P. Basic Education Board, Prayagraj/respondent no.3 within a period of one week from today, the respondent no.3 will pass appropriate orders on the same expeditiously and preferably within a period of three weeks thereafter, in accordance with law.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
With the aforesaid observations and directions, present writ petition is disposed of.
