Petitioners are three in number, claim to be Headmaster in various schools in District Badaun. On attaining the age of superannuation, the petitioners will retire on 30 June 2015 from their respective institutions.
Learned counsel appearing for the petitioner submits that regulation 21 of Chapter III of the Regulation framed under the U.P. Intermediate Education Act, 1921 provides for session benefit to teachers who were retiring between 2nd July to 30th June next year which is the academic session. According to the learned counsel for the petitioner, now the academic session has been changed to Ist April to 31st March and since the petitioner's date of retirement is 30.6.2015, he submits that in view of the changed academic session, he is entitled to continue till 31st. March, 2016. Academic session has been provided under Regulation 21 in which no amendment has been made . Regulation 15 earlier provided for academic session from 2nd July to 30th June, therefore, under regulation 21 the petitioner is entitled to continue till the beginning of the next academic session.
In my view, the appropriate decision in this regard can be taken by respondent No.1 before whom the petitioner may make a representation and respondent No.1 will take a decision on the same within a period of two months from the date of filing of a representation along with a certified copy of this order.
With the above observations and direction, the writ petition stands disposed of.
