Heard learned counsel for the petitioners.
By means of present writ petition, the petitioners have prayed for direction commanding the respondents to treat them as covered by old pension scheme, as existed on the date of initiation of selection process (advertisement) pursuant to which they have been appointed and grant benefit of old pension scheme with all consequential benefits to them and not to give effect to the new pension scheme applicable from 1.4.2005.
Learned counsel for the petitioners submits that in similar circumstances, this Court vide order dated 16.2.2015 entertained the Writ A No.9325 of 2015 (Brahma Dev Singh and 28 ors vs. State of UP and ors) and granted four weeks' time to learned Standing Counsel to file counter affidavit.
Learned Standing Counsel has accepted notice on behalf of all the respondents. He prays for and is granted three weeks' time to file counter affidavit. The petitioner will have one week thereafter to file rejoinder affidavit.
Connect with Writ A No.9325 of 2015.
This matter shall not be treated as tied up or part heard with me.
