By the order dated 30.8.2019, a direction was given to the Special Secretary/Secretary, Department of Basic Education to substantiate instructions by way of filing an affidavit.
On 16.9.2019, instead of affidavit sworn in by the Principal Secretary/Secretary, Department of Basic Education, an affidavit sworn in by District Basic Education Officer, Banda was submitted. Iin light of order earlier passed on 2.8.2019, while adjourning the matter for 21.10.2019, a coordinate bench directed the Registry to send a copy of the order to the Chief Secretary, Government of Uttar Pradesh.
No affidavit sworn in by the Principal Secretary/Secretary, Government of Uttar Pradesh, Department of Basic Education as directed under the order dated 30.08.2019 has been filed so far. The petition for writ came up before us yesterday and was adjourned for today enabling the respondents to satisfy the default. But instead of filing the affidavit, an application is filed to get the petition for writ adjourned for a period of two weeks. It is really strange that the Secretary concerned instead of complying with the directions given is making efforts to cause delay in judicial process. It appears that he is either having no respect for the orders of the Court or is having no knowledge about the duties assigned. Entire efforts made by the Principal Secretary in the instant matter indicate absolute non-functionality on his part. While recording our displeasure, we deem it appropriate to allow last opportunity to the respondents-State to file affidavit positively by tomorrow i.e. on 23.10.2019.
Let the matter be placed on board tomorrow i.e. on 23.10.2019 as fresh.
The Principal Secretary, Government of Uttar Pradesh, Department of Basic Education is required to be personally present before the Court to explain the circumstances in which he has not adhered the order passed by the Court.
