Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
Leading arguments has been advanced on behalf of the petitioners by Sri R. K. Ojha, learned Senior Advocate assisted by Sri Shivendu Ojha.
According to the petitioners, they being fully eligible, applied for the post of Assistant Teacher pursuant to advertisement issued in the month of December, 2016 on the basis of the Government Order dated 15.12.2016, inviting applications for vacant posts of 12,460 Assistant Teachers. The petitioners herein applied for the post of Assistant Teacher in more than one district against separate advertisement issued for the concerned districts.
Petitioners are aggrieved by the decision of the concerned District Basic Education Officers in denying them to participate in the first counselling on the ground that they have applied in more than one district. They are ready to opt for only one district and they want to leave their claim with respect to their applications in other districts.
Sri A. K. Yadav, learned counsel for U.P. Basic Education Board and learned counsel for District Basic Education Officers of different districts have supported the action and submitted that the writ petition may be dismissed, inasmuch as, the petitioners were not entitled to apply for the post of Assistant Teacher in more than one district.
Sri S. P. Singh, learned Standing Counsel submits that a week's time may be granted to the State-respondents to file counter affidavit.
In view of the aforesaid, a week's time is granted to the State-respondents to file a detailed counter affidavit annexing therewith copies of all the relevant Government Orders, advertisement, notifications, Rules etc. The petitioners shall have three days time thereafter to file rejoinder affidavit.
List peremptorily on 30.07.2018 at 02:00 PM along with all connected writ petitions.
If the counter affidavit is not filed by the State-respondents, the respondent No.1, Principal Secretary (Basic Education), U.P., Lucknow, shall remain personally present before this Court.
