learned Chief Standing Counsel on the basis of instructions outrightly submitted that there are 200 schools in which no teacher is available for imparting education. The instructions provided to him by Secretary of the Department is taken on record. It has been submitted that it shows the petitioner's inefficiency in performance of duty on the post of District Basic Education Officer as it was his duty to appoint the teachers in the schools.�

The process of selection of Assistant Teachers are in progress in which the District Basic Education Officer has to play an important role. 

We are also informed that the cut off date fixed for adjustment of Shiksha Mitra has been extended to 31.05.2015. Thus, the District Basic Education Officers still have time to achieve the target by the date fixed therefor.

Therefore, we are of the view that at this stage there was no occasion for the State Government to hold the petitioner as responsible for the latches in adjustment of Shiksha Mitra on the post of Assistant Teacher.

In the matter of appointment of Assistant Teacher in Basic Schools the District Basic Education Officer plays an important role. Therefore, in view of the facts above, we, prima-facie not find any reason to keep the petitioner under suspension. Accordingly the order of suspension dated 06.05.2015 is hereby stayed. 

Keeping in view the instructions provided by the State Government it is apparent that 200 primary basic schools are teacherless in the � district. The same may be the position in other districts of the State. Therefore, we hereby direct the State Government to ensure teacher in each and every school in all districts of the State before starting the next academic session.

The Secretary of Basic Education shall file his personal affidavit about the action taken by him.
