प्रयागराज, जेएनएन। परिषदीय स्कूलों की 69 हजार सहायक अध्यापक भर्ती जल्द पूरी होने के आसार नहीं है। इलाहाबाद हाईकोर्ट ने भर्ती के कटऑफ अंक के संबंध में दाखिल याचिका पर अहम आदेश देते हुए 19 मार्च तक रोक लगा दी है। इसके साथ ही कोर्ट ने सात जनवरी, 2019 को जारी उत्तीर्ण प्रतिशत यानी कटऑफ अंक के आदेश पर रोक दिया है। कोर्ट ने याचिका पर राज्य सरकार और सचिव परीक्षा नियामक प्राधिकारी उप्र, प्रयागराज से जवाब मांगा है। याचिका की अगली सुनवाई 19 मार्च को ही होगी।
यह आदेश न्यायमूर्ति सीडी सिंह ने मनोरमा मौर्या की याचिका पर दिया है। याचिका में कहा गया है कि सरकार ने 21 मई, 2018 को शिक्षक भर्ती में सामान्य और अन्य पिछड़ा वर्ग श्रेणी के अभ्यर्थियों के लिए कटऑफ अंक 33 व एससी/एसटी के लिए 30 फीसद रखा था, जबकि 69 हजार भर्ती प्रक्रिया में इस कटऑफ अंक में बदलाव करते हुए सात जनवरी को नया शासनादेश जारी किया गया है। इसमें सामान्य को 65 व अन्य आरक्षित वर्ग के अभ्यर्थियों के लिए 60 प्रतिशत कटऑफ अंक तय कर दिए गए।
याची ने इसे सरकार और परीक्षा संस्था का मनमाना आदेश करार देते हुए रद करने की मांग की। कोर्ट ने इस मुद्दे को विचारणीय माना और याचिका को रीना सिंह व अन्य की विचाराधीन याचिका के साथ पेश करने का निर्देश दिया। कोर्ट ने अगली सुनवाई 19 मार्च को तय करते हुए तब तक के लिए भर्ती प्रक्रिया पर स्थगनादेश पारित किया। इससे परीक्षा संस्था व प्रदेश सरकार को तगड़ा झटका लगा है।
भर्ती में आरक्षण का नहीं मिला लाभ
हाईकोर्ट ने 68 हजार 500 सहायक अध्यापक भर्ती परीक्षा में भूतपूर्व सैनिक कोटे में आरक्षण की मांग को लेकर दाखिल याचिका पर राज्य सरकार व सचिव परीक्षा नियामक प्राधिकारी प्रयागराज से जवाब मांगा है। यह आदेश न्यायमूर्ति प्रकाश पाडिया ने मुरादाबाद के सतीश कुमार की याचिका पर दिया है। याची अधिवक्ता राकेश कुमार सोनी का कहना है कि याची अन्य पिछड़ा वर्ग का पूर्व सैनिक कोटे का अभ्यर्थी है, जिसने बीटीसी के साथ टीईटी पास किया है। उसने कृष्ण बाल विद्या मंदिर इंटर कालेज मगुपुरा मझोला, मुरादाबाद में परीक्षा दी। राज्य सरकार ने तीन अक्टूबर 1990 के शासनादेश से पूर्व सैनिक को विशेष आरक्षण दिए जाने की व्यवस्था दी है, जिस पर विचार किए बिना याची को असफल घोषित कर दिया गया। याची की अभ्यर्थिता पर विचार नहीं किया गया।
शिक्षक भर्ती पर सुनवाई छह को
परिषदीय स्कूलों की 69 हजार सहायक अध्यापक भर्ती मामले में इलाहाबाद हाईकोर्ट में दाखिल एक अन्य याचिका में सुनवाई गुरुवार को पूरी नहीं हो सकी। यह सुनवाई अब छह फरवरी को होगी। तब तक कोर्ट ने सचिव परीक्षा नियामक प्राधिकारी कार्यालय के अधिवक्ता को बेहतर जानकारी उपलब्ध कराने का समय दिया है। यह आदेश न्यायमूर्ति प्रकाश पाडिया ने रवि प्रकाश श्रीवास्तव की याचिका पर दिया है। परीक्षा नियामक प्राधिकारी कार्यालय के अधिवक्ता का कहना था कि एनसीटीई की ओर से जारी दिशा निर्देशों का पालन करते हुए परीक्षा कराई गई है। बने नियमों पर परीक्षा संस्था का कोई नियंत्रण नहीं है।

Learned counsel for petitioner submits that as per the advertisement dated 01.12.2018, the State Government issued a Government Order notifying the Assistant Teachers Recruitment Examination, 2019 for filing up 69,000 posts for Assistant Teachers in Junior Basic School of the State. The State Government was issued guidelines in pursuance of the Government Order dated 21.05.2018, by which the qualifying marks for General and O.B.C. candidates was 33% and for SC/ST candidates was 30%. Vide Government Order dated 07.01.2019 after the notification of the Government Order the minimum marks for the qualification were amended and the new criteria for the qualification of General category candidates is 65% and 60% for the Reserved categories including other Backward Caste and Scheduled Caste/Scheduled Tribes.
Learned counsel appearing on behalf of the petitioner next submitted that the change in the qualifying marks after the advertisement or the notification by the Government for notifying of the Assistant Teachers Recruitment Examination, 2019 for filing up all the posts available for Assistant Teachers in the Junior Basic School of the State is arbitrary and is not sustainable in the eyes of law. The petitioner is belonging to the O.B.C. category, and he has already been appeared in the examination held on 06.01.2019. After the examination, this notification has come on 07.01.2019 as the Government of U.P. issued the impugned Notification.
Learned counsel for petitioner supplied a copy of order dated 21.01.2019, passed in Civil Misc. Writ- A No. 713 of 2019 (Reena Singh and 74 Others Vs. State of U.P. and 3 Others) and he prays to connect the present writ petition with the aforesaid writ petition.
Learned counsel appearing on behalf of the State submits that this is a policy matter and requires instructions.
No need to issue notice to the respondents, as the Standing Counsel representing all the four respondents.
Learned Standing Counsel prays for and is granted four weeks' time to file counter affidavit. Two weeks shall have thereafter, to file rejoinder, if any.
Connect along with Writ-A No. 713 of 2019, and list on 19.03.2019 before the appropriate Bench.
The Government Order dated 07.01.2019, annexure no. (9) to the writ petition shall remain stayed, till the next date of listing.
