The appellant appeared in the U.P. Teachers Eligibility Test-2018 ( In short U.P.T.E.T.-2018) and was provided with the D series of the question booklet by the invigilator. The result of the appellant has been declared to be "Invalid Language".
The question booklet was in five parts and the part three was in respect of Language-II wherein 30 questions of English, Urdu and Sanskrit were optional. The candidate had to opt for one of the three languages and to answer only 30 questions of that particular language. The appellant opted for Sanskrit and answered the questions of Sanskrit from serial Nos. 61 to 90 but her result has been declared to be invalid for the reason that on the top of the OMR sheet where the option for the language was to be exercised, the appellant had failed to colour/blacken the option of Sanskrit.
Learned Single Judge has directed for consigning the writ petition filed by the appellant for the reasons contained in his order dated 17.12.2018 passed in Writ -A No.26173 of 2018, Rajesh Kumar Yadav and 20 others Vs. State of U.P. and 2 others which also pertained to discrepancy in the declaration of result of U.P.T.E.T.-2018 but without discussing the facts of the case of the appellant.
The aforesaid writ petition was decided on the basis of the production and scrutiny of the OMR sheet of the appellants in that writ petition. However, the OMR sheet of the appellant was never called for and produced before passing the impugned order.
In view of above, learned Standing Counsel for the respondents No.1 to 3 is directed to produce the original of the OMR sheet of the appellant.
As prayed by the learned Standing Counsel put up on 11.01.2019 on which date the OMR sheet shall be produced.
In the meantime, as the recruitment� examination for the post of Assistant Teachers (Primary level) is scheduled to be held on 06.01.2019, it is directed that the appellant be permitted provisionally to appear in the said examination and the result shall be subject to the decision of this writ petition.
