The issue before the Court in the instant writ petition is whether the petitioner, who possesses the qualification of B.Ed. (Special Education), is entitled to participate in the recruitment as an assisted teacher in pursuance of the impugned advertisement. The grievance of the petitioner is that in the impugned advertisement, the said qualification has not been included as a valid qualification to entitle a person to participate in the selection.

On the other hand, Sri A. K. Yadav, learned standing counsel also representing U.P. Basic Shiksha Parishad, Allahabad has made a statement before this Court that in view of the recent amendments carried out in the Uttar Pradesh Basic Education (Teachers) Service Rules 1981, B.Ed. (Special Education), D.Ed. (Special Education) have been included as a valid qualification for a person being appointed as assistant teacher in Junior Basic Schools after completion of six months of special training programme in Elementary Education. It is submitted that in such circumstances, the apprehension of the petitioner is wholly unfounded. In case she applies, she would be considered in accordance with law.

📌 ALLAHABAD HIGHCOURT, DED, BLED : इलाहाबाद हाईकोर्ट ने प्राथमिक स्कूलों में 12 हजार 460 सहायक अध्यापकों की भर्ती में डीएड व बीएलएड (विशेष शिक्षा) की योग्यता रखने वाले अभ्यर्थियों को भी शामिल करने का निर्देश दिया

In view of the aforesaid statement made by learned standing counsel, it is hereby provided that in case the petitioner applies for appointment, she shall be permitted to appear in the selection, which is to be held in pursuance of the impugned advertisement.
List in the week commencing 30 January, 2017.
In the meantime, counter affidavit, if any, be filed by the State respondents.
