CONTEMPT, ALLAHABAD HIGHCOURT, BSA, RETIREMENT : लखीमपुर खीरी के बीएसए अवमानना के दोषी, हाईकोर्ट की लखनऊ खंडपीठ ने बीएसए पर जानबूझ कर कोर्ट की अवहेलना का आरोप तय करने का किया निश्चय, वित्त एवं लेखाधिकारी को भी नोटिस जारी

ALLAHABAD HIGHCOURT, BSA, RETIREMENT : लखीमपुर खीरी के बीएसए अवमानना के दोषी, हाईकोर्ट की लखनऊ खंडपीठ ने बीएसए पर जानबूझ कर कोर्ट की अवहेलना का आरोप तय करने का किया निश्चय, वित्त एवं लेखाधिकारी को भी नोटिस जारी

लखनऊ । इलाहबाद हाईकोर्ट की लखनऊ खंडपीठ ने लखीमपुर खीरी के जिला बेसिक शिक्षा अधिकारी (बीएसए) को अवमानना के मामले में प्रथमदृष्टया दोषी पाते हुए 10 अप्रैल को उन पर आरोप तय करने का निश्चय किया है। कोर्ट ने बेसिक शिक्षा विभाग के वित्त एवं लेखा अधिकारी को भी नेाटिस जारी कर उन्हे तलब किया है। यह आदेश न्यायमूर्ति ऋतुराज अवस्थी की पीठ ने नईम अली शाह की याचिका पर पारित किया।

कोर्ट ने 30 अगस्त 2016 केा बीएसए को आदेश दिया था कि याची की सेवानिवृत्त संबधी देयों के भुगतान के बाबत निर्णय लिया जाए। याची ने अवमानना याचिका दायर कहा कि बीएसए ने कोर्ट के आदेश को नहीं माना है। इस पर कोर्ट ने बीएसए को तलब किया था। सुनवाई के दौरान सामने आया कि तलबी होने के बाद भी याची के देयों के बाबत निर्णय नहीं लिया गया अपितु कहा गया कि इस पर अतिम निर्णय वित्त अधिकारी को लेना है। इस पर कोर्ट ने कड़ी नाराजगी जाहिर की और कहा कि बीएसए ने कोर्ट के आदेश की जानबूझकर अवहेलना की है।

Mr. Mukund Madhav Asthana, learned counsel appearing for opposite party informs that decision with respect to payment of post retiral benefits in compliance of writ Court's order is to be taken by the Finance and Accounts Officer and, therefore, the opposite party has nothing to do.

The writ Court vide order dated 30.8.2016 has issued a positive direction to the District Basic Education Officer, Lakhimpur Kheri to take a final decision in the matter.
Admittedly, the order passed by the writ Court has not been complied in true letter and spirit as post retiral benefits of the petitioner have not been released till date.

In this view of the matter, the opposite party cannot be absolved of his responsibility of complying the Court's directions.
Prima facie, a case for non-compliance and willful disobedience is made out against opposite party.
List this case on 10.4.2017 for framing of charges against opposite party.
In the meantime, notice be issued to the Finance and Accounts Officer, Basic Education, Lakhimpur Kheri, who shall be present before the Court on 10.4.2017 along with opposite party.
