Heard learned  counsel  for  the  petitioner,  learned  Standing Counsel  appearing  for  the  State-respondent  no.1  and  Sri Y.S.Bohra,  learned  counsel  appearing  for  respondents  no.2 and  3. By  means  of  this  writ  petition,  the  petitioner  has  raised  a grievance  that  he  was  appointed  as  Assistant  Teacher  on compassionate   ground  upon  the  death  of  his  wife    on 26.5.2014  in  a  Primary  School  run  and  managed  by  the Basic  Education  Board.  The  said  order  of  appointment, however,  came  to  be  cancelled  by  the  impugned  order   dated  7.6.2014  on  the  ground  that  the  petitioner  was  wrongly appointed  in  a  Primary  School  as  he  does  not  possess  basic qualification  of  BTC  or  equivalent  Training  Certificate It  is  submitted  that  the  petitioner  is  a  B.Sc.  and  Bachelor  of Education  as  well  as  he  has  qualified  Teachers  Eligibility Test  for  Primary  Level    and  Junior  High  School  Level.

It  is further  submitted  that  there  are  institutions  of  Junior  High School  Level,  which  are  also  run  and  managed  by  the  Basic Education   Board   and   therefore,   the   petitioner   may   be considered    for   being   appointed    in   such   Junior   High School,    which  is  maintained  and  run  by  the  Basic  Education Board  according  to  his  qualification.  The  representation  is said  to  have  been  filed  before  the  District  Basic  Education Officer-respondent  no.2  where  the  matter  is  said  to  be  still pending.

The  writ  petition  is  disposed  of  with  the  direction  to  the District  Basic  Education  Officer-respondent  no.2  to  consider the  claim  of  the  petitioner  for  appointment  in  Junior  High School  run  and  maintained  by  the  Basic  Education  Board,  if the  petitioner  possesses  requisite  qualification  and    pass appropriate  orders      in  accordance  with  law  within  a    period of  four  months  from  the  date  a  certified  copy  of  this  order  is   presented    before  it.

 याचिकाकर्ता के लिए सीखा वकील सुना, याचिकाकर्ता एक शिकायत उठाया गया है स्थायी वकील सीखा वकील इस रिट याचिका के माध्यम से No.2 और 3 उत्तरदाताओं के लिए प्रदर्शित होने, राज्य-प्रतिवादी नंबर 1 और श्री YSBohra के लिए प्रदर्शित होने के सीखा है कि वह एक प्राथमिक स्कूल समय में 2014/05/26 पर उसकी पत्नी की मौत पर अनुकंपा आधार पर सहायक शिक्षक के रूप में नियुक्त किया है और बेसिक शिक्षा बोर्ड द्वारा प्रबंधित किया गया था। नियुक्ति के बारे में कहा क्रम, हालांकि, वह यह है कि प्रस्तुत की है बीटीसी या समकक्ष प्रशिक्षण प्रमाणपत्र की बुनियादी योग्यता के अधिकारी नहीं है के रूप में याचिकाकर्ता को गलत तरीके से एक प्राथमिक विद्यालय में नियुक्त किया गया था कि जमीन पर 2014/07/06 दिनांकित impugned आदेश से रद्द कर दिया जाने लगा याचिकाकर्ता एक बीएससी है और वह प्राथमिक स्तर और जूनियर हाई स्कूल स्तर के लिए योग्य शिक्षकों पात्रता परीक्षा है बैचलर ऑफ एज्युकेशन के रूप में भी।

यह आगे भी चलाने के लिए और बेसिक शिक्षा बोर्ड द्वारा प्रबंधित और इसलिए याचिकाकर्ता मूल द्वारा बनाए रखा और चलाया जाता है, जो इस तरह के जूनियर हाई स्कूल में नियुक्त किए जाने पर विचार किया जा सकता है जो कर रहे हैं जूनियर हाई स्कूल स्तर के संस्थानों, कि वहाँ प्रस्तुत की है उसकी योग्यता के अनुसार शिक्षा बोर्ड। प्रतिनिधित्व मामला अभी भी लंबित होने के लिए कहा है, जहां जिला बेसिक शिक्षा अधिकारी-प्रतिवादी संख्या 2 से पहले दायर किया गया है कहा जाता है।

याचिकाकर्ता अपेक्षित योग्यता और पास के पास अगर रिट याचिका, बेसिक शिक्षा बोर्ड द्वारा जूनियर हाई स्कूल चलाने में नियुक्ति के लिए याचिकाकर्ता के दावे पर विचार करने के लिए जिला बेसिक शिक्षा अधिकारी-प्रतिवादी नं .2 के लिए दिशा के साथ का निपटारा और बनाए रखा है तारीख इस आदेश की प्रमाणित प्रतिलिपि से चार महीने की अवधि के भीतर कानून के अनुसार उचित आदेशों में यह पहले प्रस्तुत किया है।
