Notice on behalf of respondent Nos.1,2,3,4,6 and 7 has been accepted by the office of learned Chief Standing Counsel, whereas Sri Ajay Kumar, Advocate has accepted notice on behalf of respondent No.5-Basic Education Board, U.P., Allahabad.

The primary issue engaging attention of this Court in this writ petition is related to the Teachers Eligibility Test (TET) which was conducted on 13.11.2011, result of which was declared on 25.11.2011.

It has been contended by the learned counsel for the petitioners that in respect of the aforesaid result, some criminal investigation is going on in district Kanpur Dehat� in Case Crime No. 675 of 2011, under Section 420, 120-B I.P.C. and Sections 7/8/9/13 of the Prevention of Corruption Act and the original result is kept in a sealed cover with the investigating agency. A statement to the aforesaid effect was given by the Circle Officer, Akbarpur before this Court at Allahabad during proceedings of Writ-A No. 33631 of 2014, Maharaj Singh Vs. State of U.P. and others which stands recorded in the order dated 2.7.2014 in the said writ petition.� The statement of the Investigating Officer recorded before this Court on 02.07.2014 in the proceeding of Writ-A No. 33631 of 2014 further reveals that Investigating Officer has stated that one copy of the CD containing result of TET examination and answer etc. was sent to the Madhyamik Shiksha Parishad.

Submission of learned counsel for the petitioners is that since the� record relating to original marks-sheets is kept in a sealed cover, it is not possible to verify the marks of the TET held on 13.11.2011 and hence the candidates claiming their appointment on the basis of said examination cannot be allowed to participate in the counsellng.

Staying the entire counselling process would not serve any purpose. Keeping in view the facts and circumstances of the case, it is provided that any counselling/absorption/appointment made by the respondents from amongst the candidates who are seeking their appointment on the basis of TET held on 13.11.2011 shall abide by the final decision of this Court in the instant writ petition. This fact shall be mentioned in all the orders of appointment if issued to such candidates.

The respondents may file their counter affidavit within a period of six weeks. Two weeks' time thereafter shall be available to the learned counsel for the petitioners to file rejoinder affidavit.

List immediately after expiry of the aforesaid period.
